Calling the Biden administration’s recent decision to include gender identity in Title IX an “election-year rush” and a threat to women — as well as “the truth” — Arkansas Gov. Sarah Huckabee Sanders signed an executive order ordering schools in her state to ignore the guidelines .
“Arkansas educational institutions will continue to enforce state law guaranteeing students’ right to privacy. Students must not be forced to shower or undress with members of the opposite sex,” states the director of executive ordersigned Thursday by the Republican governor.
Huckabee Sanders is not alone.
Several conservative groups they sued Biden’s rewrite of Title IX, and many Republican-led states are also rejecting the fresh interpretation of Title IX.
“This week, 15 states filed lawsuits accusing the federal government of overreaching and changing the nature of the original law,” Times of the era reported On May 3, “Governors and school officials in Texas, Oklahoma, Florida, Louisiana, Montana and South Carolina also told their school districts to ignore the new definition.”

“I am ordering the Texas Education Agency to ignore your illegal order,” Texas Republican Gov. Greg Abbott wrote in an April 29 memo to Biden. “The Title IX rewrite not only exceeds constitutional authority, but also tramples on laws I signed to protect the integrity of women’s sports by prohibiting men from competing against female athletes.”
Last week, a lawsuit was filed by the Independent Women’s Forum, Parents Defending Education, Speech First and several states declares illegal prescription.
“This lawsuit openly confronts the unethical charge that sex is synonymous with gender identity. Sex and gender are not the same thing, and removing gender from Title IX upends all protections for women in education – including protections for women-only sports and spaces,” said Paula Scanlan, former University of Pennsylvania swimmer and ambassador for the Independent Women’s Forum . in a press release.
In Arkansas’ case, gender is viewed as “an immutable characteristic… rooted in biology,” the ordinance states, adding biological men to female-designated sports leagues, nor can schools and universities enforce the apply of “false pronouns.”
“The right to refuse to tell a lie is guaranteed by the First Amendment. My administration will continue to protect this fundamental right,” the order states.
Many to argue Biden’s Department of Education lacks the authority to rewrite a 52-year-old federal law to redefine gender to include sexual orientation and gender identity. At the press conference announcing the Huckabee order he said “My message to Joe Biden and the federal government is that we will not comply.”

How College amendment previously reportedWhile the Biden administration has argued that the change does not create a final determination on transgender athletes, the 1,577-page rule mentions “athletics” 31 times, “sport” 10 times and “team” 111 times. The rule comes into force on August 1.
The fresh interpretation of Title IX also conflicts with several state laws, including: Times of the era reported.
“The rule changes conflict with laws in at least 11 conservative states that prohibit gender-confused men from using women’s facilities. Laws requiring students to apply the bathroom that corresponds to their gender exist in Alabama, Arkansas, Florida, Iowa, Kansas, Kentucky, North Dakota, Oklahoma and Tennessee, it said.
