House Republicans have referred Hunter and James Biden to the Justice Department for criminal prosecution, accusing them of making false statements to Congress during the impeachment inquiry into President Joe Biden.
The criminal cases were filed Monday and come nearly seven months after House Republicans first approved an impeachment inquiry into the 46th president.
Since then, three investigating committees have uncovered what they call a pattern of influence-peddling around Joe Biden by members of his family that has resulted in millions of dollars flowing into Hunter and James Biden’s coffers through overseas business dealings linked to allegedly corrupt oligarchs and insiders. ties to the Chinese Communist Party.
Hunter is Joe Biden’s son and Jim is the president’s brother.
“Our investigation has found that President Biden knew, participated in and benefited from his family capitalizing on the Biden name around the world,” says GOP Rep. James Comer, chairman of the House Oversight Committee, who helps direct the criminal justice process.
“Despite this evidence, President Biden continues to lie to the American people about his involvement in these influence peddling schemes. It appears that giving false testimony is a feature of the Biden family. “We caught President Biden’s son and brother lying blatantly to Congress in what appears to be a coordinated effort to conceal Joe Biden’s involvement in his family’s plans.”
Comer and two other House GOP committee chairmen — Ohio Judiciary Rep. Jim Jordan and Missouri Ways and Means Rep. Jason Smith — wrote a letter of recommendation to Attorney General Merrick Garland recommending that Biden be charged with false statements. Additionally, they recommended that Hunter Biden be held accountable perjury.
Republicans identified three instances in which they believe Hunter Biden lied to the committee.
- “[F]He also distanced himself from one of his companies, Rosemont Seneca Bohai, LLC, and its bank account, which received millions for foreign entities and individuals. Nevertheless, funds from these foreign sources were transferred to his account.
- Making false statements regarding taking a position in the same company. Documents released after the first son’s testimony show that he signed a document identifying himself as the company’s corporate secretary.
- A text conversation was misinterpreted with the director of the Chinese company “Zhao”, with whom he referred to the presence of his father in a threatening text message. Biden claimed he had mistakenly sent the message to the wrong person, but messages released by one of the committees show he was still talking to the same executive days later.
The committee also argues that the president’s brother, James Biden, lied while testifying by:
- He claims he did not meet with Hunter Biden’s business partner, Tony Bobulinski, while the group was pursuing a deal with CEFC China Energy.
Hunter Biden though he denied these statements in his testimony, claiming that James Biden was present at the meeting with him and Bobulinski.
“Lying to Congress is a serious crime with serious consequences,” Jordan said. “Hunter and James Biden did just that. They lied to cover up President Biden’s involvement in their family’s international influence-trading schemes that netted millions of dollars. These referrals are a reflection of the Biden family’s criminal wrongdoing, and the Department of Justice must take steps to hold the Bidens accountable.”
These modern referrals are part of House Republicans’ recent efforts to shift from investigation to accountability as November’s Election Day approaches. This modern push includes punitive referrals and efforts to burden parts of the Biden administration.
House Republican leaders remain cautious about rushing to impeach President Biden based on the investigation’s findings.
“Generally speaking, we utilize the power of impeachment very carefully here, as I have said many times. Next to declaring war, this is the most powerful power Congress has. And it has to be very methodical,” House Speaker Mike Johnson said Tuesday: according to Appeal.
“I believe President Biden is the worst president in the history of the country and there may be insurmountable crimes… The investigation is ongoing… and the trial is ongoing. So I won’t commit to this matter this morning. We must allow the constitutional process and our constitutional responsibility to play out.”
Criminal cases will likely face hurdles at the Justice Department, which reports to President Biden’s pick for Garland attorney general.
The agency has so far obstructed aspects of the House Republican-led investigation, including: refusing deliveries audio recording of President Biden’s interview with Special Counsel Robert Hur regarding Biden’s mishandling of classified documents.

However, Chairman Smith believes that the referrals will give the department a chance to prove itself President Biden’s claims that no one is above the law.
