House Speaker Mike Johnson issued a statement Wednesday banning biological men from women’s bathrooms, according to a press release obtained by the Daily Caller News Foundation.
Johnson stated that “all same-sex facilities in the Capitol and House office buildings (such as restrooms, locker rooms, and locker rooms) are reserved for persons of that biological sex.”
The statement was issued by South Carolina Republican Rep. Nancy Mace introduced on Monday, a resolution requiring people in the Capitol to apply facilities that correspond to their biological sex was passed shortly before Democratic Congresswoman Sarah McBride was sworn in as the first member of Congress to identify as transgender.
Johnson also noted that “each member office has its own private restroom, and unisex restrooms are available throughout the Capitol.”
“Women deserve a women-only space,” Johnson said.

Johnson said in a statement that the policy affirmed existing House rules regarding single-sex facilities at the Capitol.
“I’m not going to advocate for a man, you know, there’s someone in the women’s locker room with a penis. It’s not right” – Mace he told reporters Tuesday. “And I am a victim of violence myself. I am a rape victim. I have post-traumatic stress disorder (PTSD) caused by the abuse I experienced at the hands of a man, and I know how vulnerable women and girls are in private spaces.”
Mace was raped by a friend and classmate at the age of 16. According to for the Post and Courier and has since stated that the traumatic experience resulted in “the most difficult time of her life”.
The issue of transgender people using opposite-sex restrooms gained national attention after a biological boy from Loudon County, Virginia, raped a student in a public school girls’ bathroom in 2021. The school continued deny that the assault was the result of its trans-inclusive policies.
