Nearly 1 million undocumented migrants benefit from ‘silent amnesty’ under Biden, House of Representatives report finds

A report released Thursday found that nearly 1 million undocumented migrants in the United States have benefited from a “quiet amnesty” implemented by the Biden-Harris immigration court system.

The cases of more than 700,000 undocumented migrants have been administratively closed, terminated or dismissed, allowing them to remain in the country “indefinitely” without facing immigration consequences. According to report released by the House Judiciary Committee, chaired by Ohio Republican Rep. Jim Jordan. The findings, which the commission called a “quiet amnesty,” come after record levels of illegal immigration into the country under the current administration.

“For nearly four years, Americans watched as President Joe Biden and Border Vice President Kamala Harris exited the Southwest border and welcomed nearly 8 million undocumented immigrants into the United States,” the report said.

The report detailed that the immigration court system is facing a massive backlog due to an unprecedented border crisis and a surge of foreign nationals seeking asylum. The backlog increased from 1.2 million cases at the end of the Trump administration to nearly 3.5 million cases at the end of the third quarter of fiscal year 2024, a 175% boost.

The Executive Office for Immigration Review (EOIR) additionally reported nearly 109,100 cases as “outstanding” for fiscal year 2023, meaning the cases were completed but not resolved on the merits of the claims, according to the House report. In the first nine months of fiscal year 2024 alone, there were 109,568 pending asylum cases, which has already exceeded the total number of asylum cases in the previous fiscal year.

By comparison, a total of just 12,960 asylum cases were reported as “pending” in fiscal years 2017-2020, according to the chamber’s report.

The report found that the Biden-Harris administration also failed to file the required documentation to begin immigration court removal proceedings in approximately 200,00 cases, resulting in the “overwhelming majority” of these non-citizens being allowed to remain in the country in time indefinite.
