The left has discovered that when all else fails, the legal system must be used to remove conservative political leaders. There are several significant areas in society that the left has significant control over. These are the education system, the government bureaucracy, the legal system, and the media. They employ the education system to teach leftist values to children so that they will become Democrats. They employ the media to lend a hand get elected by smearing Republican candidates and providing free, glowing coverage to Democratic candidates.
But sometimes those two strongholds aren’t enough to oust Republican incumbents. That’s where the legal system comes in. Democrats are drawn to the legal system. The state bars are controlled by the left. That’s partly because Republican lawyers are more likely to have families and church activities that take up their free time, so they have less time for extracurricular activities like running for state bar or joining the state bar association.
The judiciary is also leaning left. To become a judge, a lawyer must have high grades in law school. It is much harder for a conservative law student to get A grades because law school faculties are almost monolithically liberal. Only 15 percent law professors are conservative. My favorite area of law is constitutional law, going back to college. But when I was in law school, my freshman constitutional law professor, known to be far left, told me that my academic record was equivalent to a “D.” Under Obama, the judiciary has shifted even further to the left, as nine of the 13 U.S. courts of appeals acquired more judges appointed by Democrats than by Republicans. The U.S. Supreme Court is not a very good check in this regard, accepting only about 80 appellate cases each year.
The left has become more adept in recent years at taking down prominent conservatives through bogus or exaggerated lawsuits. Dinesh D’Souza, Rick Perry, Bob McDonnell, Tom DeLay, Ted Stevens, Sheriff Joe Arpaio and Rick Renzi are some of their most high-profile victims. DeLay, Stevens, Perry and McDonnell were ultimately acquitted, but at the cost of millions of dollars in attorney fees and five of the seven losing their political careers. Renzi continues to appeal.
Even if the legal challenge to Trump is lucky enough to reach the U.S. Supreme Court, which is roughly evenly split between left and right, lower courts will have the opportunity to drag out the legal proceedings for years first, tarnishing Trump’s reputation.
Can a sitting president be prosecuted? John P. Carlin, former assistant attorney general for national security, he said in the article for The Washington Post that it is possible. If special counsel Robert S. Mueller III finds that Trump committed a crime, he could refer the case to the prosecution, rather than to Congress for impeachment. The Justice Department’s Office of Legal Counsel takes the position that a president cannot be prosecuted until he leaves office, but that position has never been tested in court. Hofstra Law Professor Eric Freedman he argues that the office’s interpretation “is contrary to the history, structure, and philosophy underlying our government, is contrary to precedent, and is not supported by practical considerations.”
Trump could also be the subject of civil lawsuits. U.S. Supreme Court held Paula Jones could continue her sexual harassment lawsuit against Bill Clinton while he was president. Lawsuit against Trump over Trump University real estate seminars uninterrupted after he was elected. A federal judge approved the $25 million settlement in March.
Professor Edward Foley, Director of the Election Law Department @ Mortiz at Moritz College of Law at The Ohio State University, he said Whether the civil lawsuits can proceed will likely be decided on a case-by-case basis. He said that’s because “there’s a risk that a civil lawsuit will be a real distraction that outweighs the interests of the parties in the civil lawsuit.”
The left knows this and realizes that dragging out a lawsuit for years could really damage Trump’s reputation, as well as his ability to govern. It could be very time-consuming, limiting his ability to fulfill his presidential duties. Everyone remembers when Sarah Palin resigned as governor of Alaska because he said ethics investigation into her made it harder for her to do her job. Her enemies were using it to destroy her. She explained, “I will not allow the people of Alaska to go through a year of a paralyzed, paralyzed administration and do nothing. … Especially with all these legislators lining up for office. Their desire would be to tear down the administration left and right so they can line up for office.”
Even if the left ultimately doesn’t win in court against Trump, it can drag out legal proceedings for years to destroy his reputation. The lawsuits are so complicated that the general public doesn’t understand many of them—which is why they’re an ingenious tactic. Ordinary Americans don’t want to believe that the judiciary is corrupt. Ask anyone what happened to Tom DeLay or some of the other conservative leaders I mentioned earlier. The media vilified DeLay for so many years and barely mentioned his eventual acquittal that most people I spoke with still don’t realize he was acquitted. The left is counting on this legal tactic as its final ace up its sleeve against Trump. The right needs to watch out and start preparing for this inevitable vile tactic.
