Obama-appointed judges overturn part of Biden’s student loan repayment plan

Obama-appointed federal judges on Monday blocked part of the Biden administration’s Savings for Valuable Education (SAVE) plan in response to state Republican lawsuits.

Judge John A. Ross of Missouri and Judge Daniel Crabtree of Kansas blocked part of the SAVE administration’s decisions plan, which was an income-driven repayment program designed to lower monthly costs for borrowers. The court rulings prohibit the Department of Education from further reducing payments or eliminating further debt under the Politico program reported.

Ross ruled that “defendants are tentatively enjoined from further loan forgiveness to borrowers” under the plan pending the court’s full review of the case, and Crabtree is provisionally blocked parts of the program that, according to court documents, will further reduce monthly installments for some borrowers. Ross’s executive order goes into effect immediately, and the second one will go into effect on June 30, giving the administration time to appeal.

“We strongly disagree with the U.S. District Court rulings in Kansas and Missouri that block elements of the SAVE plan that help student loan borrowers make affordable monthly payments and avoid default. The Department of Justice will continue to vigorously defend the SAVE plan,” said U.S. Secretary of Education Miguel Cardona. he said in a statement.

Kansas Attorney General Kris Kobach filed lawsuit in March, while Missouri Attorney General Andrew Bailey filedin April, and both events resulted from the loan forgiveness program being found unconstitutional.

“The president must not thwart the Constitution if it suits his political program. I am filing a lawsuit to stop his brazen attempt to curry favor with some citizens by forcing others to assume their debts. The Constitution will mean something as long as I am attorney general,” Bailey said in a statement press release when the first lawsuit was filed.

In June 2023, the Supreme Court shot down government’s plan to forgive student loans for the nearly 40 million Americans who exercise executive power. Biden introduced the SAVE plan shortly after the Supreme Court ruling that would have capped student loan repayments at 5%. the borrower’s monthly income from the 10% limit.

The offices of the attorneys general of Missouri and Kansas did not immediately respond to the Daily Caller News Foundation’s request for comment.
