Emails obtained in January by the nonprofit Parents Defending Education show Education Secretary Miguel Cardona requested the NSBA for the letter. However, the Department of Education denies that Cardona requested the letter.
Just days after the NSBA sent a letter to the White House, Garland released a statement note On October 4, he directed the FBI and other law enforcement agencies to “deal with threats against school administrators, board members, teachers and staff.”
During October testimony before Congress, Garland refused to withdraw his memo even after the NSBA apologized for his letter because he did not adopt the same language. This was despite his testimony that the memo was prepared in response to the NSBA letter.
“Attorney General Garland testified in Congress that his memorandum was based on a now debunked and rescinded letter prepared by individuals within the federal government (EOP, ED, and DOJ) working with the National School Boards Association (“NSBA”) dated September 29, 2021 ” – we read in the lawsuit.

Emails obtained in November by Parents Defending Education show that the NSBA had been in contact with the White House and the Department of Justice for several weeks before its September 29 letter.
